Procedure for obtaining authorization to temporarily access the port area to carry out professional audiovisual activities involving drones (or UAS).

Who can carry out the procedure?

Port facilities, companies and/or professionals of audiovisual activities and authorized drone pilots (in that order) as the party responsible for or interested in the activity.

Result

Authorization for access to the Port of Barcelona to carry out the activity applied for at the indicated time and in the sectors and/or wharfs authorized for the activity.

The administration’s failure to respond

Shall mean that authorization is granted. Except in cases requiring private use of port public property.

Necessary documentation

The documentation listed here must be submitted at least 10 days before the scheduled date of the photography shoot or filming:

Application Form, properly filled in

Besides the documentation from the companies and/or professionals (e.g. production companies) applying to carry out the activity, the following documentation from drone pilots shall be submitted:

  • Registered Drone Pilot Certificate.
  • Remotely piloted drone operations reported to the Spanish Ministry of the Interior and the Catalan Ministry of the Interior.
  • Communication to and authorization from the Spanish Aviation Safety and Security Agency, AESA (as necessary) and ENAIRE with the conditions of use applicable to these operations.
  • A flight plan of the operations to be carried out, indicating the areas to be overflown and the drone take-off/landing points.
  • Operational Risk Assessment document providing proof of the operation category (open or specific), and the emergency response procedure (ERP), statement submitted to Spanish Aviation Safety and Security Agency (AESA) on the specific standard scenario, authorization for the specific operation or LUC.
  • Document in which the pilot analyses compliance with the different conditions required by Delegated Regulation (EU) 2019/945, depending on the size of the drone and its operation. Instead of compliance with all requirements of the relevant class, what is required is the pilot’s analysis of the operation/drone.
  • Drone Liability Insurance in accordance with Regulation (EC) 785/2004.
  • Necessary flight coordination, e.g. with APB Heliport (CAT Helicopters), SEM.
  • Authorization from port facilities (land, ships, etc.) to be overflown.
  • In the case of operations to be carried out in the Public Area of the Port (Port Vell), notification shall be provided to and/or authorization shall be applied for from the management entity “Gerència Port Vell”.
  • Pilot documentation:
    • Drone Pilot’s License
    • Practical drone training certificate
    • Radio Operator’s Certificate for operations in controlled airspace

Taxes/Rates

If authorization for the event is granted, the port tariffs in force shall be applied for authorizations involving private use of public property, use of the water surface or devices floating in the water, as well as the airspace corresponding to these areas.
